Generally, treatment is offered as an option for those accused of nonviolent drug related crimes who do not have a list of prior offenses before being arrested. The treatment can be ordered instead of a prison sentence, used to reduce a prison sentence, or as a condition of release on probation, parole, or before the trial begins.

In many jurisdictions patients will have a degree of choice over the type of treatment they go through. There does not seem to be a correlation between the initiative taken by the patient and the success of rehab.
