Generally, treatment is offered as an option for those accused of nonviolent drug related crimes who do not have a list of prior offenses before being arrested. The treatment can be ordered instead of a prison sentence, used to reduce a prison sentence, or as a condition of release on probation, parole, or before the trial begins.

In many jurisdictions patients will have a degree of choice over the type of treatment they go through. There are a variety of approved treatment facilities throughout Maryland, with some offering residential treatment and others offering outpatient counseling. Many patients and loved ones are surprised to learn that according to the National Institute on Drug Abuse, mandated treatment can be as effective as voluntary treatment.
