For some people, the only way to get that “wake up call” to get help for overcoming a drug or substance abuse issue is to have been arrested and charged with a crime because of it. When this happens, a person may have the option of avoiding jail time if they agree to receive treatment.

Generally speaking, this concept of court-ordered treatment is favorable for those who qualify both for the individual in question as well as the legal system and society. Why? Because the individual will receive the help that he or she needs, thereby preventing such an incident from occurring again, which also betters society and prevents repeat offenders.

Drug and substance abuse continues to be an issue throughout the United States, with the state of Virginia being no exception. In fact, 513,000 Virginia residents used illicit drugs in the past month. Furthermore, it’s estimated that 123,000 experienced behavior reminiscent of illicit drug dependence over the past year. As far as alcohol goes, state estimates identify some 198,000 citizens as being dependent on it and up to 457,000 that either abuse or are dependent on it.

On a national scale, it’s estimated that some 13.7 million arrests are made each year, 1.7 million of which are believed to be related to drugs or drug possession. Hence, admitting those who’ve committed drug – or alcohol-related – crimes into treatment facilities helps heal them, while not crowding and using the resources of prisons.

Court-Ordered Treatment 101

Individuals who seek court-ordered treatment generally do so by one of three ways. One, treatment can be ordered by the judge in lieu of or as part of one’s sentence. Secondly, the individual’s lawyer may strike a deal with the prosecutor allowing for treatment in lieu of a prison sentence. And finally, the individual may appear in drug court instead of in adult criminal court.

The big question is whether or not court-ordered, or “forced” treatment is as effective for people who willingly enter such treatment facilities. The answer is “yes.” Not only is treatment more effective than jail time, but studies show that those who enter and complete court-ordered treatment are less likely to fail drug tests and less likely to be arrested again following discharge. While individuals can’t be “made” to do anything or change their way of thinking, most studies highlight the effectiveness of treatment for changing people’s ways of thinking after entering the facility.
